Federal Judge Mandates Release of Abrego Garcia from Immigration Detention
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. Following his repatriation to the United States to answer alien smuggling allegations, he was detained in federal detention.
In her decision, the court noted that the government lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
